Trading Risk Disclosure

This Trading Risk Disclosure Addendum (“Risk Disclosure”) supplements the NexTick360 Terms of Service. By using NexTick360, you acknowledge and agree to the risks described below.

1. General Trading Risk

Trading futures and other derivative instruments involves substantial risk of loss and is not suitable for all individuals. You may lose more than your initial investment. Market conditions may change rapidly. Leverage can work against you as well as for you.

You should carefully consider whether trading is appropriate for you in light of your financial condition, experience level, and risk tolerance.

2. Futures Trading Specific Risk

Futures trading involves a high degree of leverage. A small price movement may result in substantial losses. Additional risks include:

  • Margin calls and forced liquidation
  • Rapid market volatility
  • Reduced liquidity during certain trading hours
  • Slippage and execution delays
  • Exchange-imposed trading halts

You are solely responsible for monitoring your trading account and managing your risk.

3. No Broker or Execution Relationship

NexTick360:

  • Is not a broker or execution platform
  • Does not hold customer funds
  • Does not transmit orders
  • Does not execute trades
  • Does not clear or settle transactions

All trades are placed directly through your chosen broker or execution platform. NexTick360 connects to execution platforms in a strictly read-only capacity to capture trade and market data for analytics purposes.

4. No Investment Advice

NexTick360 provides analytics, performance measurements, and behavioral insights only. AI-generated outputs, coaching summaries, strategy scoring, and performance analytics are:

  • Informational
  • Data-driven
  • Based solely on historical user data
  • Not personalized investment advice

Nothing within the Service constitutes a recommendation to buy, sell, hold, or trade any financial instrument.

5. Technology & Data Risk

Trading decisions may rely on third-party execution platforms, market data feeds, internet connectivity, and cloud infrastructure. Delays, outages, incorrect data, or system failures may occur.

NexTick360 does not guarantee real-time data accuracy, continuous system availability, or error-free analytics. You remain responsible for verifying all trade decisions independently.

6. Execution Analytics Limitation

Execution quality metrics (including slippage, mark-outs, aggression scores, and contextual market snapshots) are calculated using derived analytics. These calculations:

  • Are retrospective
  • May rely on limited contextual data windows
  • Should not be interpreted as predictive indicators

Past execution performance does not guarantee future execution outcomes.

7. Psychological & Behavioral Scoring Disclaimer

Behavioral insights, discipline scores, mood tracking, and sentiment analysis are analytical tools only. They are not medical advice, psychological diagnosis, or professional mental health services.

If you believe trading is affecting your mental health, you should consult a qualified professional.

8. User Acknowledgment

By using NexTick360, you acknowledge that:

  • You understand the risks of trading.
  • You are solely responsible for your trading decisions.
  • You will not rely on NexTick360 as a substitute for independent judgment.
  • You assume full responsibility for any financial losses incurred.

9. Regulatory Notice

Futures and leveraged trading products are regulated by U.S. authorities including the Commodity Futures Trading Commission (CFTC). NexTick360 is not registered with the CFTC, SEC, NFA, or any regulatory body as a broker-dealer, futures commission merchant (FCM), commodity trading advisor (CTA), or investment adviser.

The Service is a software analytics tool only.

10. Acceptance of Risk

Your use of the Service constitutes your express acknowledgment and acceptance of all trading-related risks. If you do not accept these risks, you must discontinue use of the Service.
